Booking Conditions

Please note that these Booking Conditions apply to bookings made from February 22, 2022 onwards, including all new bookings.

If you booked your trip before February 22, 2022, the Booking Conditions you accepted at the time of booking still apply.

Please take 5 minutes to read and understand the booking conditions below before booking a trip with TOG.
We strongly recommend that you also read Essential Travel Information and Important Notes Related to Your Trip prior to booking to ensure you understand the itinerary, style and physical needs of the trip you are taking.
Essential travel information and important notes relating to your trip can be found on our website.

For additional terms that may apply according to the type of trip, Special Conditions will apply.

1. Our contract

All bookings are made with the TOG entity, consequently by booking a trip with us, you have agreed to be bound by the terms and conditions set out in:

  1. These Booking Conditions;
  2. Essential tour / excursion information that applies to your trip;
  3. Any applicable Special Conditions, (where and if any).

Your booking will be accepted by us on this basis.
The services to be paid will be those indicated in the invoice that you will receive at the time of payment.

2. Validity

Dates and itineraries are valid until 01 Avril 2022. Beyond 31st December 2023 dates and itineraries are only indicative and need confirmation by booking system.

To confirm the reservation it is necessary to pay a deposit equal to 50% based on the tour / excursion chosen.
If the booking is made within 15 days of the departure date, the full amount is due at the time of booking.
Deposit amounts vary for selected tour / excursion.

4. Booking acceptance & Balance

If we accept your booking, we will issue you a payment confirmation invoice.
A contract will exist between you and us from the date the confirmation invoice is issued or if you book within 15 days of departure, the contract will exist when we accept your payment.
Please refer to your booking confirmation invoice for final payment details, including how to make payment.
The payment of the balance of the travel price is due 15 days before the departure date, unless otherwise provided and will be indicated in the Special Conditions if necessary.
If this balance is not paid by the due date, we reserve the right to consider your booking as canceled and the cancellation fees described in clause 7 (Cancellation) will apply.

5. Rates and surcharges

Our tour / excursion prices are subject to variable and seasonal prices. This means that our travel prices may vary at any time based on demand, market conditions and availability at the time of the request.
Different passengers may have been charged different prices on the same journey.
Any reduced prices or discounts that may become available after paying the deposit will not be applied.
If you wish to cancel your reservation to take advantage of a cheaper price, the conditions of total cancellation apply as indicated below in clause G (Cancellation by you).
The most up-to-date prices are displayed on our website.
Prices are based on MGA / EUR currency exchange rates based on the weighted exchange rate of the various local banks; Please note that prices may vary depending on the currency in which the booking is made.
We reserve the right to impose surcharges up to 28 days before departure due to unfavorable changes in exchange rates, increases in air fares or other increases in transportation costs, increases in local operator costs, taxes or if the action government should require us to do so.
If a surcharge results in an increase of more than 10% in the travel price, you can cancel your booking within 14 days of notification of the surcharge and get a full refund.
Please note that a surcharge may apply to a purchase made with a credit card or other payment system.

6. Your data

In order for us to confirm the organization of the tour / excursion, it is necessary to provide all the requested details with the balance of the travel price.
The details required vary by tour / excursion, include, but are not limited to, full name such as passport, date of birth, nationality, passport number, passport issue and expiration date, and any pre-existing medical conditions that may affect the your ability to complete travel arrangements.
On some more challenging trips, we also ask you to complete and submit a self-assessment form that will be provided to you at the time of the tour / excursion.

7. Cancellation

If you cancel some or all parts of your booking, the cancellation terms set out below will apply.
A cancellation will only be effective when we receive relevant written confirmation of the cancellation.

If you cancel a trip:

  1. 28 days or more prior to departure, we will hold the deposit amount as a credit;
    or
  2. 27 days or less prior to departure, we will keep 50% of the amounts paid by you in connection with the booking as credit and we will keep the remaining 50% of the amounts paid by you in connection with the booking.
    Any credit resulting from a cancellation under this clause 7 (Cancellation) does not have an expiration date and can be applied to any other available tour / excursion offered by us.
    This credit is not transferable or redeemable for cash.
    This credit excludes flights or insurance as they will have their own booking conditions.

Please note that different cancellation conditions apply to certain tour / excursion styles and additional services as set out in the Special Conditions and (if any) the Essential Tour / Excursion Information relating to your trip.
We strongly recommend that you take out cancellation insurance at the time of booking.
If you leave a trip for any reason after it has started, we are not obligated to refund any unused services.
If you do not sign up for a trip, join it after departure or leave it before its completion, no refund will be made.
The cancellation terms above are in addition to the rates that may be collected by third party accommodation providers, travel agents or tour commissions and transport operators.
Please refer to clause 19 (Liability), which provides more information about your rights under the Madagascar law on travelers which may apply to your cancellation.

8. Cancellation by us

In the event that we cancel your tour / excursion, you can transfer the amounts paid to an alternative departure date or receive a refund, unless your trip is canceled due to a force majeure event (as defined below in this clause 8.

Cancellation due to Force Majeure

If a trip is canceled due to a force majeure event, we can offer you a choice between:

(1) a credit of 100% of the sums paid for the tour / excursion;

or

(2) a refund less sunk costs.

If the cancellation due to a force majeure event occurs after the start of the trip, we can offer you a prorated choice:

(1) 100% credit for the remaining days during the stay;

or

(2) refund less sunk costs of the remaining days during the stay.

Any credit resulting from a cancellation under this clause 8 (Cancellation by us):

does not have an expiration date and can be applied to any other available tour / excursion offered by us;
it is not convertible into cash;
excludes flights or insurance as they will have their own booking conditions.
A “Force Majeure Event” includes but is not limited to: force majeure; war; civil turmoil; revolt; blockade or embargo; fire; explosion; failure; trade union dispute; earthquake; epidemic, pandemic, or other health emergency; flood; wind storm or other extreme weather event; lack or failure of supply courses; passage of any law, order, proclamation, regulation, ordinance, request, requisition or requirement or any other act of any governmental authority, beyond the reasonable control of the parties, foreseeable or not, that would make it dangerous or impractical for a tour / hike to start or continue.

In the event of cancellation, there will be no claim from either party against the other and we are not responsible for any incidental expenses you may have incurred as a result of your booking including but not limited to visas, vaccinations, travel insurance deductibles or non-refundable flights.

9. Changes to the booking

Transfers to a third party or an alternative tour / excursion are permitted only when operationally possible and, in the case of a transfer to a third party, only if the transferee meets all the requirements relating to the tour / excursion.
Some fees may apply.
Prices are set annually as defined in clause E above.

No changes to the booking are allowed within 14 days of departure.

10. Inclusions

The price of your tour / excursion does not include:

  1. international or domestic flights unless specified
  2. airport transfers, taxes and excess baggage charges unless specified
  3. meals other than those specified and mentioned in the Tour / Excursion Information
  4. fees for visas and passports
  5. travel insurance
  6. room services and cleaning services
  7. everything that is not mentioned
  8. optional activities and all personal expenses.
11. Exclusions

The price of your tour / excursion does not include:

  1. international or domestic flights unless specified
  2. airport transfers, taxes and excess baggage charges unless specified
  3. meals other than those specified and mentioned in the Tour / Excursion information
  4. fees for visas and passports
  5. travel insurance
  6. room services and cleaning services
  7. everything that is not mentioned
  8. optional activities and all personal expenses.
12. Age and health requirements

Minimum age:

For most of our tours / excursions, the minimum age is 6 years.
All travelers under the age of 18 must be clearly accompanied by a legal guardian, or in place of a legal guardian, by an accompanying person over the age of 18, appointed by their legal guardian.
Your legal guardian or designated person will be responsible for the day-to-day care of the traveler under the age of 18.
If a legal guardian chooses to designate an escort in their place, he or she will be required to complete and sign a relevant document, to delegate his or her authority.

Maximum age:

For most of our trips, we have no maximum age restrictions, although we remind you that our trips can be physically demanding and passengers must ensure they are adequately fit to allow full participation. We can provide details on mandatory health requirements; however, we are not medical experts.
It is your responsibility to ensure that you obtain adequate and detailed medical advice at least two months prior to travel for the latest health requirements and recommendations for your destination.

13. Additional Terms

Due to the nature of some of our tours / excursions, in addition to these Booking Conditions, you may be required to sign and submit a separate waiver, different terms and / or release form to a third party provider that is helping to manage your tour / excursion.

To the extent that there are inconsistencies between the terms of these Booking Conditions and the additional waiver, the terms of these Booking Conditions will prevail and supersede any additional waivers.
We reserve the right to deny you participation if you have not signed a waiver.

14. Passports & Visa

It is your responsibility to obtain information and have in your possession all required documentation and identification required for entry, departure and travel in each country or region you visit during your trip.
This includes a valid passport and all travel documents required by us and / or the relevant government authorities, including all visas, permits and certificates (including, without limitation, vaccinations or medical certificates) and insurance policies. Your passport must be valid for up to 6 months before its expiration.
You accept full responsibility for obtaining all these documents, visas and permits prior to the commencement of stays and you are solely responsible for the full amount of costs incurred due to missing or defective documentation.

15. Travel Insurance

Travel insurance is mandatory for all our travelers and must be taken out at the time of booking.
Your travel insurance must provide coverage against personal accident, death, medical expenses and emergency repatriation with a minimum recommended coverage of $ 200,000 for each of the coverage categories.
We also strongly recommend that it covers cancellation, curtailment, personal liability and loss of baggage and personal effects.
You must provide your travel insurance policy number and the 24 hour emergency number of the insurance company at the time of our request; you will not be able to participate in the trip without these details.
If you have travel insurance linked to your credit card or bank account, make sure you have all the details on that.

16. Change of itinerary

You appreciate and acknowledge that the nature of this type of tour / excursion requires considerable flexibility and you should consider alternatives. The itinerary provided for each tour / excursion is representative of the types of activities contemplated, but it is understood that the route, timetables, itineraries, services and modes of transport may be subject to change without notice due to circumstances or events locals.

While we strive to operate all tours / excursions as described, we reserve the right to change the circuit itinerary.

Before departure: If we make a major change, we will notify you as soon as reasonably possible if there is time.
The definition of major change is considered a change that affects the course of the itinerary.
When a major change is made, you can choose to accept the change, get a refund of the money paid on the land portion of the tour / excursion only, or accept an alternative tour / excursion offered.

After departure: We reserve the right to change an itinerary after departure due to local circumstances or an event of force majeure. In such emergency circumstances, the additional cost of any necessary itinerary changes will be borne by the user.

Please note that we are not responsible for any incidental expenses that may be incurred as a result of any changes to itineraries including but not limited to visas, vaccinations or non-refundable or non-changeable flights.

17. Authority on tour

Our tours / excursions are managed by a guide / escort.
The guide / cescorts decision is final on all matters that may affect the safety or well-being of any traveler or staff member participating in the tour / excursion.
If you do not respect a decision made by a guide / escort, or interfere with the well-being or mobility of the group, the guide / escort may invite you to leave the tour / excursion immediately, without the right to a refund.
We may also choose not to transport you on any future booked tours / excursions.
You must always comply with the laws, customs, exchange and drug regulations of all countries you visit and you also agree to travel in accordance with our Responsible Travel Guidelines.

18. Acceptance of Risk

You acknowledge that the nature of the tour / excursion can be adventurous and participation involves some degree of personal risk. You may visit places where political, cultural and geographical attributes present greater dangers and physical challenges than those present in our daily life.

Recognize that you choose to travel at a time when you may be exposed to the COVID-19 virus.
For our part, we will take all reasonable steps to ensure your safety and may require you to follow additional security protocols during your stay.

We use the updated information on the locations and sites of the various departments and the reports of our contacts to evaluate if the itinerary is ok. However, it is also your responsibility to inform yourself of all relevant tour / excursion information, including applicable health risks and the nature of your itinerary.
You acknowledge that your decision to travel is made in light of consideration of this information and you agree to be aware of the personal risks associated with such tour / excursion. To the fullest extent permitted by law, we assume no liability in connection with these additional risks.

19. Responsibility and guarantee of the service

Our services which include our “Services”) may have guarantees that cannot be excluded by Madagascar consumer law.

19.1 To the fullest extent permitted by law we exclude any liability to you or any other person (whether for contractual or other tort) for any loss (direct, indirect, consequential) including death or personal injury or damages of any kind that may be suffered as a result of any act or omission, negligent or otherwise, by or on our behalf in connection with the Services or any other matter or thing relating to these Booking Conditions, except to the extent that such loss or damage is incurred as a direct result of our fraud or willful misconduct.

19.2 (Limitation of Liability) Where the law implies a guarantee in these Booking Conditions that cannot be legitimately excluded, our liability for the breach of this guarantee will be limited to the provision of the Services again or to the payment of the cost of the new provision. services.

19.3 (Indemnity) You indemnify us (and all our subsidiaries, officers, employees, contractors and agents) against all losses, claims, proceedings, damages, costs and expenses (including attorney’s fees) arising from any third party claims arising directly or indirectly from or in connection with:

(a) your access to or use of the Services, this includes your delegate’s access to or use of the Services; And
(b) any violation by you (or your proxy) of:

(i) these Booking Conditions; or
(ii) any additional terms applicable to the provision of the Services,

except to the extent that such loss or damage is the direct result of our fraud or willful misconduct.

19.4 (Third Parties) We contract with various companies, business providers, accommodation providers, airlines, bus and transfer companies, tour and local guides, government agencies, independent contractors and individuals to assist in the management of our travel as agents for these third parties (Third Party Provider).
Third party suppliers may also use the services of local operators and subcontractors.
While we take all reasonable steps to select reputable third party suppliers, we cannot be responsible for their acts or omissions.
All services provided by Third Party Providers may be subject to the terms and conditions imposed by these Third Party Providers and you may be required to sign additional terms.
These may limit or exclude the liability of the Third Party Provider.
You acknowledge that Third Party Providers operate in compliance with the applicable laws of the countries in which they operate and we do not warrant that Third Party Providers will comply with the laws of your country of residence or any other jurisdiction.

We are not responsible for the acts and omissions, negligent or otherwise, of these third party suppliers. Any disputes between you and any third party must be resolved solely between you and that party.

19.5 (Vicarious Liability) We will not be held indirectly liable for intentional or negligent acts of persons not dependent on us or for intentional or negligent acts of our employees committed off-duty or outside the course and scope of their employment.

20. Optional activities

Optional activities not included in the tour / excursion price are not part of the product or this contract.
You agree that any assistance, recommendations or advice given by your group leader or local representative in arranging optional activities (including before or after a tour / excursion) will not make us liable in any way.
The contract for the provision of that business will be between you and the business provider.

21. Privacy Policy

Any personal information we collect about you will be handled in accordance with our Privacy Policy and may be used for any purpose associated with the operation of a tour / excursion.
By making this booking you agree that this information will be passed on to relevant persons such as our agents, service providers or other suppliers to enable us to operate the tour / excursion or, if permitted by relevant anti-spam laws, to send you marketing material in relation to our events. and special offers.

The user is responsible for periodically reviewing this Privacy Policy and for informing himself of any changes to this Privacy Policy.

22. Privacy Policy

From time to time, we may post promotions and special offers (Promotions) on our website that are subject to both these Booking Conditions and any additional promotion-specific terms that are incorporated into these Booking Conditions by reference.
Be sure to read the specific conditions that apply to each Promotion.

The promotions are available for a limited time, as defined on our website.
We reserve the right to cancel or amend any Promotion at any time at our discretion.
By purchasing a tour / excursion on a promotional basis, you are accepting and agreeing to the terms that apply to the applicable Promotion.
In the event of any inconsistency between these Booking Conditions and the Promotion Terms, the Promotion Terms will apply to your booking.
